The Italian Court of Cassation has released decision number 2281/2025. The case is related to the iure sanguinis recognition of citizenship. A Brazilian citizen got the recognition thanks to a decision of an Italian Tribunal. Then, the Italian civil status officer of the town of Vittorio Veneto refused to transcript her birth certificate before the decision had become final. This refusal did harm the claimant, with respect to health care, access to job market, etc. The Cassation has now ruled that the behavior of the Italian civil status officer was unlawful. According to general principles, civil judge decisions are immediately effective. So, it is not necessary that the Italian judge decision became final, in order to transcript the birth certificate.
